MyPhysician360 Legal & Compliance Notice 

For Pharmacy Partners Participating in the MyPhysician360 Telehealth Platform

Purpose and Scope

This Pharmacy Legal & Compliance Notice and related materials (collectively, the “Guidelines”) are provided by Physician360, Inc. (“MyPhysician360”) for informational and operational support purposes only. These Guidelines are intended to promote consistency, quality, and alignment across participating pharmacy partners utilizing the MyPhysician360 telehealth platform. 

These Guidelines apply to all pharmacies participating in or seeking to participate in the MyPhysician360 platform and should be read in conjunction with applicable agreements, including but not limited to pharmacy participation agreements, provider agreements, and service level expectations.

No Legal or Medical Advice

The Guidelines do not constitute legal advice, medical advice, or regulatory guidance. MyPhysician360 does not provide legal, clinical, or compliance advisory services to pharmacies. 

Each pharmacy is solely responsible for: 

  • Ensuring compliance with all applicable federal, state, and local laws and regulations  
  • Maintaining appropriate licensure and certifications  
  • Adhering to professional standards of practice, including but not limited to USP compounding standards and applicable telehealth prescribing requirements  

Pharmacies are encouraged to consult with qualified legal counsel, regulatory advisors, and clinical leadership to ensure full compliance.

Independent Responsibility of Pharmacy

Participation in the MyPhysician360 platform does not relieve pharmacies of their independent legal, regulatory, or professional obligations. 

Each pharmacy acknowledges and agrees that: 

  • All dispensing decisions, compounding practices, and patient interactions remain under the sole responsibility of the pharmacy and its licensed professionals  
  • The pharmacy retains full accountability for prescription fulfillment, ingredient sourcing, formulation practices, and patient safety  
  • The pharmacy is responsible for ensuring that all prescriptions are filled in accordance with applicable laws, regulations, and clinical standards  

Completion of the Compliance Checklist or adherence to these Guidelines does not guarantee compliance with applicable laws or regulatory requirements.

Telehealth and Regulatory Variability

Telehealth laws, prescribing regulations, and pharmacy practice requirements vary by jurisdiction and are subject to change. 

Pharmacies are solely responsible for: 

  • Understanding and complying with all applicable direct prescribing laws in the states in which they operate  
  • Ensuring that prescriptions originating from telehealth encounters are dispensed in accordance with state-specific requirements  
  • Maintaining awareness of evolving regulatory frameworks that may impact pharmacy operations  

MyPhysician360 makes no representations or warranties regarding regulatory compliance across jurisdictions.

No Provider or Patient Relationship

Nothing in these Guidelines, the Compliance Checklist, or participation in the MyPhysician360 platform is intended to: 

  • Establish a direct provider-patient relationship between MyPhysician360 and any patient  
  • Establish a direct pharmacist-provider relationship between MyPhysician360 and any pharmacy  

Clinical care, prescribing decisions, and patient interactions are conducted by licensed providers and pharmacies operating independently within their respective scopes of practice. MyPhysician360 does not control or direct pharmacy operations, compounding practices, or dispensing decisions.

Compliance Monitoring and Review

MyPhysician360 reserves the right, at our sole discretion, to: 

  • Review pharmacy compliance within the scope of these Guidelines  
  • Request documentation, including but not limited to:  
  • Licensing and accreditation records  
  • Compounding and sourcing documentation  
  • Prescription and dispensing records (as permitted by law)  
  • Monitor prescription trends, ingredient usage, and platform activity  

Pharmacies agree to cooperate with reasonable compliance inquiries and provide requested documentation in a timely manner to the extent permitted by applicable law.

Non-Compliance and Enforcement

Failure to adhere to applicable laws, regulations, or MyPhysician360 Guidelines may result in corrective action, including but not limited to: 

  • Requests for remediation or corrective action plans  
  • Temporary suspension from the platform  
  • Permanent removal from participation  

MyPhysician360 reserves the right to take any action it deems necessary to protect patient safety, platform integrity, and regulatory compliance.

No Warranty or Guarantee of Compliance

MyPhysician360 makes no representations or warranties, express or implied, that adherence to these Guidelines will: 

  • Ensure compliance with applicable laws or regulations  
  • Prevent regulatory scrutiny or enforcement actions  
  • Guarantee clinical or operational outcomes  

All participation is at the pharmacy’s own risk and responsibility.

Updates and Modifications

MyPhysician360 reserves the right to update, modify, or revise these Guidelines to reflect: 

  • Changes in regulatory requirements  
  • Updates to platform operations  
  • Evolving clinical or compliance standards  

Pharmacies will be notified of material updates as appropriate. Continued participation in the platform constitutes acceptance of any updated terms.

Confidentiality and Use

These Guidelines may contain proprietary and confidential information belonging to Physician360, Inc. They are intended solely for use by authorized pharmacy partners. Unauthorized use, distribution, or reproduction of these materials is strictly prohibited without prior written consent. 

Acknowledgment Agreement 

Pharmacy agrees to: 

  • Comply with all applicable federal, state, and local laws and regulations  
  • Adhere to MyPhysician360 platform expectations, including compliance, safety, and quality standards  
  • Maintain all required licenses, certifications, and documentation  
  • Notify MyPhysician360 of any material changes to licensing, accreditation, or regulatory status  
  • Cooperate with reasonable compliance reviews and documentation requests  

Pharmacy further acknowledges that: 

  • All dispensing decisions, compounding practices, and patient interactions remain under the sole responsibility of the Pharmacy and its licensed professionals  
  • Participation in the MyPhysician360 platform does not guarantee regulatory compliance  
  • Failure to meet compliance standards may result in corrective action, including suspension or removal from the platform  

By signing into the MyPhysician Pharmacy Application, the pharmacy representative acknowledges that they have received, reviewed, and understand the MyPhysician360 Pharmacy Legal & Compliance Notice.
